HMP Terms & Conditions – Twilio SMS Services

1. Acceptance of Terms

Welcome to HMP. These Terms and Conditions explain the rules for accessing and using the HMP platform, including any related mobile application, web portal, participant dashboard, study tools, content areas, forums, surveys, notifications, incentives, and connected features made available through a specific study or program.

By creating an account, logging in, or using HMP, you agree to follow these Terms and Conditions. If you do not agree, you should not use the platform. Your participation in any research study may also be governed by a separate informed consent form, study protocol, privacy notice, or institutional policy.

2. Purpose of HMP

HMP is a digital health platform designed to support research studies and health related programs. The specific features available to you may vary depending on the study, site, or program in which you are enrolled.

HMP may include educational articles, activities, surveys, check-ins, forums, messaging, points, badges, rewards, reminders, study announcements, and other interactive features. Some studies may also include additional study specific tools, features, or activities.

HMP is not intended to provide medical diagnosis, treatment, clinical care, emergency response, or crisis support.

3. Eligibility and Account Access

You may use HMP only if you are authorized to access the platform through a participating study, program, institution, or approved implementation. Some versions of HMP may have age requirements, study eligibility requirements, location requirements, or other access limits.

You agree to provide accurate information when creating or using your account. You are responsible for keeping your username, password, authentication method, and device access secure. You should not share your account with anyone else or allow another person to use your account.

If you believe your account has been accessed without permission, you should contact the study team or technical support contact as soon as possible.

4. Study Specific Requirements

Your use of HMP may be tied to a specific research study, pilot, implementation project, or program. Study specific requirements, expectations, incentives, participation rules, and participant rights will be described in the relevant consent form, study materials, or program documents.

These Terms and Conditions do not replace the informed consent process, or any rights described in an approved consent form. If there is a conflict between these Terms and Conditions and an approved study consent form, the study team and institutional representatives should determine which requirements apply.

5. User Responsibilities

You agree to use HMP in a respectful, lawful, and appropriate manner. You agree not to misuse the platform, interfere with its operation, try to gain unauthorized access, impersonate another person, submit false information, or use the platform in a way that harms other users, study staff, researchers, institutions, or the platform itself.

You are responsible for the information, comments, posts, responses, images, or other content you submit through the platform. You should not post or share information that you do not want others to see in areas where other users may have access.

6. Community Guidelines and Forum Conduct

If your version of HMP includes forums, discussion boards, comments, messaging, peer interaction, or other community features, you agree to engage respectfully. You may not harass, threaten, bully, shame, exploit, intimidate, stalk, impersonate, or target other users or staff.

You may not post hate speech, discriminatory comments, personal attacks, sexually explicit content, graphic content, spam, scams, false information presented as fact, illegal content, or content that encourages harm to yourself or others. You may not share another person’s private information, including names, contact information, health information, photos, study details, or other identifying details without permission.

HMP may allow users to report, flag, or block other users. Study staff or platform administrators may review, hide, edit, remove, or restrict content that violates these Terms, study guidelines, community standards, or applicable law. Repeated or serious violations may result in account restrictions or removal from platform features.

7. User Generated Content

You may be able to submit content through HMP, including forum posts, comments, messages, survey responses, activity responses, goals, reflections, images, or other materials. You remain responsible for the content you submit.

By submitting content, you give HMP, the study team, and authorized administrators permission to host, display, review, moderate, process, and use that content as needed to operate the platform, administer the study, support participant engagement, troubleshoot technical issues, and comply with study related requirements.

User generated content may be subject to moderation. The platform is not required to publish, maintain, or display any user-generated content.

8. Health Information and Educational Content

Content provided through HMP is for educational, engagement, and research support purposes only. It should not be interpreted as medical advice, diagnosis, treatment, mental health counseling, medication management, or a substitute for care from a qualified professional.

You should contact a healthcare provider, mental health professional, pharmacist, case manager, or other appropriate professional for questions about your health, medications, symptoms, treatment, testing, prevention options, physical activity, nutrition, mental health, or other personal concerns.

If you are experiencing a medical emergency, mental health crisis, thoughts of self-harm, thoughts of harming someone else, or any urgent safety concern, call emergency services or contact an appropriate crisis resource immediately. HMP is not continuously monitored and should not be used to request emergency assistance.

9. Surveys, Assessments, Prompts, and Activities

HMP may include surveys, assessments, check ins, daily or weekly prompts, ecological momentary assessments, quizzes, activities, study tasks, goal tracking, or other participant inputs. These features may be used to support research procedures, engagement, self-reflection, or study related communication.

You should complete study activities honestly and to the best of your ability. Some activities may be optional, while others may be required or tied to study participation. Study specific requirements should be described in your consent form, onboarding materials, or study instructions.

10. Notifications and Communications

HMP may send notifications, emails, text messages, reminders, announcements, prompts, or other communications related to platform activity, study tasks, account access, rewards, technical updates, or study participation. The types of communication may vary by study.

You may be able to change some notification settings through the platform or your device settings. However, some administrative, study related, safety related, or account related communications may still be sent when needed.

SMS Notifications

With your consent, HMP may send you SMS (text) messages related to your participation, including program reminders, health and wellness content, and informational notifications. Message frequency varies. Message and data rates may apply. You may opt out at any time by going into the settings of the app and turning off notifications. For help, contact HMP@nursing.fsu.edu. Consent to receive SMS messages is not required as a condition of using the Services or participating in any program. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. For more information, see your study’s Privacy Policy.

11. Points, Badges, Incentives, and Rewards

HMP may include points, badges, progress indicators, store features, gift card redemption, milestones, or other incentives. These features are intended to support engagement and may vary by study, participant group, site, or implementation.

Points, badges, and in-platform rewards do not have cash value unless a specific study or program clearly states otherwise. Incentive structures, point limits, reward options, redemption requirements, timelines, budgets, and availability may change based on study procedures, funding, technical needs, fraud prevention, or administrative review.

The study team or platform administrators may correct points, reverse rewards, pause redemptions, or deny incentives if there is suspected error, misuse, duplicate activity, automated activity, false information, account sharing, technical manipulation, or other behavior inconsistent with study expectations.

12. Privacy and Data Use

Your privacy is important. Information about what data HMP collects, how data are used, who may access data, how data are protected, and how long data may be retained should be described in the applicable Privacy Policy, consent form, study materials, or institutional privacy documentation.

These Terms and Conditions summarize rules for use of the platform. They are not a substitute for a full Privacy Policy or informed consent document. You should review the applicable privacy and consent materials before using the platform.

13. Intellectual Property

HMP, including its name, logos, design, software, features, platform structure, educational materials, study content, images, graphics, videos, text, questionnaires, activities, and other materials, may be protected by copyright, trademark, licensing, or other intellectual property rights.

Unless specifically allowed by the study team or institution, you may not copy, reproduce, distribute, sell, modify, publish, scrape, reverse engineer, or reuse HMP materials outside of personal study participation or approved program use.

14. Platform Changes and Availability

HMP may be updated, revised, paused, limited, or discontinued at any time. Features may be added, removed, renamed, redesigned, or changed based on study needs, participant feedback, technical improvements, funding, security needs, regulatory review, or implementation requirements.

HMP may not always be available. Access may be affected by maintenance, updates, outages, device issues, internet connection, third party services, account status, or study related decisions. The platform does not guarantee uninterrupted or error-free operation.

15. Account Suspension, Deactivation, or Removal

Your access to HMP may be limited, suspended, deactivated, or removed if you violate these Terms, violate study rules, misuse the platform, engage in unsafe or harmful behavior, submit false information, interfere with platform operations, withdraw from a study, become ineligible, or complete study participation.

When a study ends or your participation ends, your access to some or all platform features may be removed. Study data and platform records may be retained according to the applicable protocol, consent form, privacy policy, institutional policies, and legal requirements.

16. No Warranty

HMP is provided for research, education, engagement, and study support purposes. To the extent permitted by applicable law, the platform is provided as is and as available, without warranties of any kind, whether express or implied.

HMP does not guarantee that the platform will meet every need, be available at all times, be free from errors, produce any specific health outcome, or provide complete, current, or personalized guidance for every user.

17. Limitation of Liability

To the extent permitted by applicable law, HMP, participating institutions, study teams, sponsors, developers, administrators, and related collaborators are not responsible for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, inability to use the platform, reliance on platform content, technical issues, third party integrations, or user generated content.

18. Changes to These Terms

These Terms and Conditions may be updated from time to time. Updates may reflect platform changes, study procedures, legal requirements, privacy requirements, security practices, or institutional policies. If the Terms are updated, HMP or the study team may provide notice through the platform, email, study materials, or other appropriate communication channels.

Continued use of HMP after changes are posted or communicated means you agree to the updated Terms, unless a study specific process requires a different form of acknowledgement.
