1. Introduction
Welcome to HealthMpowerment (“HMP,” “HealthMpowerment,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the HealthMpowerment website, mobile application, digital platform, content, tools, community features, notifications, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not access or use the Services.
2. Purpose of HealthMpowerment
HealthMpowerment is a digital health and wellness platform designed to provide educational information, resources, interactive tools, and supportive features for eligible users. The Services may include content related to sexual health, HIV and STI prevention and treatment, PrEP, medication habits, mental health, nutrition, relationships, housing, discrimination, faith, spirituality, and other social factors that influence health and well-being.
The Services may be adapted for different programs, populations, projects, or health topics. Some features may be available only to certain users based on eligibility, enrollment, program participation, location, age, or other criteria.
3. No Medical Advice or Emergency Services
The Services are provided for general educational, informational, engagement, and support purposes only. HealthMpowerment does not provide medical diagnosis, treatment, clinical decision-making, emergency care, or individualized medical advice.
You should consult a qualified healthcare provider before making health decisions or changing any medication, treatment, prevention plan, care routine, or health-related behavior. Do not ignore or delay professional medical advice because of information provided through the Services.
If you are experiencing a medical emergency, mental health crisis, or immediate danger, call 911 or your local emergency number. If you are in the United States and experiencing suicidal thoughts or emotional distress, you can call or text 988 for the Suicide & Crisis Lifeline.
4. Eligibility
You may use the Services only if you are eligible under the requirements that apply to the relevant HealthMpowerment program, project, application, or service. Certain Services may require registration, screening, consent, assent, parental or guardian permission, verification, or other onboarding steps.
You agree to provide accurate, current, and complete information when requested. You may not impersonate another person, misrepresent your identity, or use the Services on behalf of someone else unless expressly authorized.
5. Accounts and Security
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You should choose a username that does not reveal your real name, email address, social media identity, or other identifying information.
You agree to notify us promptly if you believe your account or device has been accessed without authorization. You are responsible for using reasonable safeguards, such as device passcodes, biometric locks, updated software, and secure passwords.
6. Privacy
Your use of the Services is also governed by the applicable HealthMpowerment Privacy Policy and any additional privacy notices that apply to a specific program, project, or feature. Those materials explain how information may be collected, used, stored, protected, and shared.
By using the Services, you acknowledge the applicable privacy practices. If you do not agree with those practices, do not use the Services.
7. Community Features and User Content
Some Services may allow you to post, upload, send, submit, or share content, including comments, forum posts, messages, responses, reflections, survey answers, profile information, or other materials (“User Content”). You are responsible for your User Content.

You retain ownership of content you submit. By submitting User Content, you grant HealthMpowerment and its authorized service providers, partners, and administrators a limited, non-exclusive license to host, store, process, display, moderate, transmit, and use that content as needed to operate, maintain, protect, evaluate, and improve the Services.
Additional permissions or restrictions may apply to specific programs, research activities, or features, as described in applicable notices, consent materials, or program guidelines.
9. Notifications and Communications
The Services may send push notifications, reminders, content alerts, program updates, administrative messages, or other communications. You can manage certain notification settings through your device or application settings, although disabling notifications may affect your ability to receive reminders or participate in certain features.
Notifications should not be relied on for emergencies or urgent medical needs.
10. Third-Party Links and Resources
The Services may link to third-party websites, services, resources, providers, or content. These links are provided for convenience, education, or reference only. We do not control and are not responsible for third-party content, privacy practices, terms, accuracy, security, or availability.

Some HealthMpowerment programs, projects, studies, pilots, or partner implementations may have additional terms, privacy notices, community guidelines, consent materials, or participation requirements. If additional materials apply to your use of a specific Service, you agree to follow them.
If there is a direct conflict between these Terms and a program-specific agreement or consent document, the program-specific document will control to the extent of the conflict.

We may update, suspend, modify, limit, or discontinue any part of the Services at any time. Features may vary by program, project, user role, location, eligibility, device, or version. We are not liable for any modification, suspension, or discontinuation of the Services.
15. Suspension or Termination
We may suspend or terminate your access to the Services if you violate these Terms, violate applicable guidelines, create safety or security risks, misuse the platform, become ineligible, or if the relevant program or Service ends.
You may stop using the Services at any time. If you participate in a specific program, you should follow the applicable withdrawal, close-out, or account deactivation instructions.

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, and non-infringement.

To the fullest extent permitted by law, HealthMpowerment, Florida State University (FSU), and their affiliates, partners, service providers, licensors, officers, directors, employees, contractors, researchers, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of or inability to use the Services.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless HealthMpowerment, Florida State University (FSU), and their affiliates, partners, service providers, licensors, officers, directors, employees, contractors, researchers, and agents from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the Services, your User Content, your violation of these Terms, or your violation of another person’s rights.

These Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, unless another governing law is required by an applicable program agreement, institution policy, or law.
If you access or use the Services from outside the United States, you are responsible for complying with applicable local laws. The Services are controlled and operated from the United States and are not intended to subject Florida State University to the laws or jurisdiction of any location outside the United States except as required by applicable law.

We may update these Terms from time to time. Updated Terms will be posted in the Services or otherwise made available to you. Your continued use of the Services after updated Terms are posted means you accept the updated Terms.
